Family-Based Green Card Eligibility
Tax Compliance
It is incredibly important to file and pay taxes on all income you earned while in the United States. Failure to do so can negatively impact your ability to demonstrate good moral character and satisfy residency requirements.
Waiver of Inadmissibility
Because you indicated you are subject to the bars in INA §§ 245(c)-(e), you will likely need to discuss a waiver of inadmissibility with an attorney to proceed.
Parole-in-Place
Because you have a spouse or child in the US armed forces, you may be eligible for "Parole-in-Place," which can allow you to adjust your status without leaving the US, even if you originally entered without inspection.
Criminal Convictions
Depending on the specific crime you were convicted of, you may not be eligible to obtain legal permanent residency, or you may require a specialized waiver. It is highly advised to review your criminal record with an immigration attorney.
Multiple Entries
Entering the United States more than once can trigger the "permanent bar" depending on the facts of your case and your immigration status at the time. It is crucial that you speak with an attorney before filing anything.
Removal Proceedings
Past or current removal (deportation) proceedings severely impact your case and must be handled correctly in immigration court. You should speak with a lawyer before attempting to file anything pro se.
Proof of Marriage (Bona Fides)
Providing evidence of a legitimate, shared life together is mandatory. It is important that you start gathering proof of your marriage (joint accounts, leases, utility bills, photos) as soon as possible.
Conditional Residency
Because you have been married for less than two years, you will be granted Conditional Residency (a green card valid for 2 years). You and your spouse will be required to file a joint petition to remove these conditions 90 days before the card expires.
